JUDGMENT : Amol Rattan Singh, J. Learned counsel for the petitioner in all these petitions first points to the order of the Joint Development Commissioner (IRD), Rural Development and Panchayats Department, Punjab, (exercising the powers of the Commissioner), dated 30.05.2018, Annexure P-5, to submit that while adjourning the appeal filed by the petitioners against the order of the Collector-cum-DDPO, Tarn Taran, dated 12.04.2018, Annexure P-4, to August 22, 2018, status quo had been directed. However, thereafter, without any reason, the appeal was ordered to be taken up on 27.06.2018, vide the impugned order dated 11.06.2018 (Annexure P-6), with dasti notices issued to all the parties. 2. On that date (27.06.2018), the appellate authority is stated to have not held court and consequently the appeal had been adjourned till today, though it is contended that the said authority actually holds Court only on Wednesdays with all other cases other than the present cases involving village Kairon, Tehsil Patti, District Tarn Taran, ordered to be heard on 12.07.2018. It is contended that the order in these cases has been passed only because Panchayat Elections are to be held prior to September, 2018. 3. Though, undoubtedly, it is seen that the appeals were shown to be adjourned to August 22, 2018 vide the order dated 30.05.2018 (P-5), however, the advanced date of hearing 27.06.2018 having already gone by and the petitioners therefore having enough notice of the date of hearing today, I see no reason to interfere in the appeal proceedings; and while therefore dismissing these petitions, still, in view of the fact that the impugned order does not reveal any reasons for suddenly advancing the date of hearing, it is directed that if an adverse order against the petitioners is passed, it shall not be given effect to for a period of 15 days after it is passed, to enable the petitioners in all these petitions to take their remedies.
