ORDER 1. Delay condoned. 2. Leave granted in SLP (Crl.) No. 753 of 2017. 3. Mohd. Javed, Wasim Khan, Raju @ Tribhuvan Gosai, Pamma @ Paramjit, Rajesh Arora @ Golu are the appellants in these appeals before us. They stand convicted under Section 302/34 read with Section 120B IPC and sentenced to undergo life imprisonment for the murder of Ravi Srivastav. Apart from the five appellants, one Mangal Singh alias Mangi co-accused was convicted under Section 302 by the trial Court and he did not prefer any appeal either before the High Court or before this Court. Raj Dharikar @ Raj Khanjar co-accused has been acquitted. 4. According to the prosecution on 22.04.1995 at 8.00 p.m., PW-1 Mateen Khan was going on motorcycle with the deceased on main road NH-43. The assailant, who was later identified as Mangal Singh fired two gun shots from behind resulting in death of Ravi Srivastav. Apart from the identification of Mangal Singh as the assailant by direct evidence of P.W-1, the eye witness, all the five appellants were implicated only on account of phone connectivity as per call records which information has been collected during the investigation. 5. We have heard learned counsel for the parties and perused the evidence on record. We do not find it safe to uphold conviction of the appellants solely on the basis of call records, in absence of any other corroborative evidence. 6. Accordingly, we give them benefit of doubt and set aside their conviction and sentence and the acquit them. 7. The appellants Rajesh Arora and Pamma @ Paramjit are in custody. They may be released forthwith if not required in any other case. 8. The appellants Mohd. Javed, Wasim Khan and Raju @ Tribhuvan Gosai are on bail. Their bail bonds stand discharged. 9. The appeals are allowed in above terms.
