JUDGMENT Mr. Surya Kant, J.: (ORAL) - The petitioner seeks bail in the case FIR No.69, dated 16.04.2013, under Sections 22/25-A/27-A/29/22/61/85 of the Narcotics Drugs and Psychotropic Substances Act, 1985 and Sections 420, 467, 468, 471 IPC, registered at Police Station Fatehgarh Sahib, District Fatehgarh Sahib, primarily on health grounds as according to him he is required to undergo surgery. 2. Keeping the aforesaid plea in view, the State of Punjab was directed to get the petitioner examined by a Medical Board of the Government Medical College and Hospital at Patiala. Learned State counsel has submitted the report indicating that the petitioner has a cist in the lumber area with back ache. Learned counsel for the petitioner submits that the petitioner has been advised surgery, which he wants to undergo in a private hospital. He further submits that he has no objection if the surgery is conducted in a private hospital at his own expenses even while in custody. 3. We find that the request made by counsel for the petitioner is fair and just. The same is accordingly accepted. The jail/police authorities are directed to get the petitioner admitted in a private hospital where he wants to be operated upon while in police custody. The expenses of the treatment shall be borne by the petitioner/his family. As soon as he recovers and is so certified by the Doctors, the petitioner would be shifted to the jail but it will be ensured that adequate medical aid is provided to him from time to time as per requirement. 4. The application as well as main case stand disposed of.
