JUDGMENT : JASPAL SINGH, J. 1. By this common order, this Court intends to dispose of two separate writ petitions bearing CWP No.25371 of 2017 and CWP No.27172 of 2017, as both these petitions involve commonality of facts, controversies and applicability of law. Though, through these petitions the petitioners have sought issuance of writ in the nature of mandamus to release the due benefits alongwith interest, yet during the course of arguments, it has been categorically admitted by learned counsel for the petitioners that retiral benefits have been released and now only the question with regard to grant of interest on delayed payment survives. 2. Mr. Aman Sharma, learned counsel representing the respondent-Corporation has fairly conceded that the controversy with regard to grant of interest on delayed payments was set at rest by this Court in CWP No.15306 of 2016, captioned as Hari Ram and others vs. Pepsu Road Transport Corporation, Nabha Road, Patiala, and other 17 petitions vide judgment dated 4.9.2017. 3. After having discussed the various judgments delivered by the Hon'ble Supreme Court as well as this Court with regard to the grant of interest on delayed payment of the retiral benefits, this Court has come to the conclusion that the petitioners are entitled to interest @ 9% per annum on the delayed payments after expiry of period of 3 months from the date of their respective retirements, till the actual payments on the various retiral benefits. 4. The respondent-Corporation is directed to calculate and make the payment of interest as referred to above to the petitioners within a period of 3 months from the date of receipt of certified copy of this order and in case of non-compliance of the aforesaid order/directions, the aggrieved petitioner shall be at liberty to approach this Court as well as/or to have recourse to the other remedies available under the law. 5. Both the petitions stand disposed of accordingly.
