JUDGMENT Sanjay Karol, A.C.J —Mr. Tara Singh, learned counsel, states that now appellant stands regularized. Office order dated 12.07.2017, is taken on record to such effect. 2. The subject matter of the appeal is appointment to the post of Part Time Water Carrier, in Government Primary School Dauladhar, District Bilaspur. 3. Appellant Sh.Madan Lal was appointed as a Part Time Water Carrier pursuant to interview held on 22.07.2002. In the said interview, appellant was awarded 27 marks, whereas, writ petitioner (respondent herein) Sh.Inder Pal was awarded 24 marks. 4. Writ petitioner laid challenge to the same on the basis of notification dated 27.07.2001, alleging that the marks awarded qua the distance to the school, were arbitrary and in violation of the said notification. 5. Learned Single Judge vide impugned judgment dated 03.03.2011, passed in CWP(T) No. 8769 of 2008, titled as Inder Pal vs. State of Himachal Pradesh and others, quashed the order of appointment of Sh.Madan Lal, dated 25.07.2002, for the reason that distance of the house of the writ petitioner was 1.08 km and that of the appellant 2.10 km, as certified by the authorities. What weighed with the learned Single Judge was the certificate of distance (Annexure A-10) issued by the authorities. 6. We may observe that such certificate was obtained and submitted much after the process of selection was over. Also as is alleged by the present appellant, distance was incorrectly measured by the authorities, for the distance through pedestrian route is much less than 2.10 kms, which distance in fact is measured through the motorable road. 7. Mr. Raman Sethi, learned counsel, states that the distance through pedestrian path to the school from the residences of both the petitioner as also the appellant, is almost same. 8. Well, we do not want to sit over the judgment of the experts, who had awarded marks for the distance on the basis of material placed on record by the candidates appearing at the time of interview. 9. On 01.04.2011, this Court by way of an interim direction had directed the arrangement existing as on that date to continue. Resultantly, present appellant continued to discharge the duties and now stands regularized. 10. For all the aforesaid reasons, we set aside the judgment dated 03.03.2011, passed in CWP(T) No. 8769 of 2008, titled as Inder Pal vs. State of Himachal Pradesh and others. 11.

We are informed that one post of Part Time Water Carrier is vacant at Government Primary School, Dauladhar i.e. school in question. 12. We are of the considered view that interest of justice would be met if the respondent-State were to offer appointment to the present respondent Inder Pal. State has already accepted the judgment in his favour. In view of the above, present appeal stands disposed of, so also pending application(s) , if any.
