JUDGMENT Sanjay Karol, A.C.J —As mutually agreed, petition is disposed of, reserving liberty to the present petitioner Gopal Singh son of Shri Narayan Dutt, resident of Village Kathyaru, P.O. Kanda, Tehsil Kasauli, District Solan, H.P., to file an appeal assailing the impugned order dated 16.06.2017, passed by Settlement Officer, Division Shimla, H.P., in Case No.87/2015, titled as Smt.Meera Devi vs. State of H.P., before the appropriate authority in accordance with law. 2. Since the petitioner has been pursing the matter before this Court, issue of limitation shall not come in his way. Also the respondent herein shall not raise the issue of maintainability of the appeal, which may be filed by the petitioner, though appeal is required to be adjudicated on merits. 3. Needless to add, this Court has not expressed any opinion on the merits of the appeal. Petition stands disposed of accordingly, so also pending application(s) , if any. Copy dasti.
