JUDGMENT & ORDER : 1. By this application u/s 439 of the CrPC accused petitioner Kartik Das sought bail in connection with Tamarhat P.S.Case No.198/2017 U/S 366 A IPC Section 4 of POCSO Act in the GR Case No.3779 of 2017 and added Section 376 IPC (Special Case No.69 of 2017). Heard the counsel for both the parties. 2. The accused is now facing trial in connection with the aforesaid case before the learned Special Judge, Dhubri. 3. It has been contended that all material witnesses has been examined including the victim and the prayer for bail of the petitioner has been rejected for which he has preferred this present petition. Statement of those witnesses has been enclosed with the record. The accused is also a student of BA who is 23 years old and has undertaken to face the trial. In view of the fact that the victim has already been examined, there appears no scope of hampering and tempering the trial by the accused person 4. Considering the above and the length of detention of the petitioner and the undertaking given, the accused is allowed to go on bail in connection with the aforesaid case on furnishing bail bond of Rs 20,000/- with a surety of the like amount to the satisfaction of the learned Special Judge, Dhubri with condition that the petitioner shall appear before the trial court regularly and willful default may invite rejection of bail. 5. Bail Application stands disposed of.
