ORDER : 1. Heard learned counsel for the parties. 2. The appellant raised grievance before the Industrial forum of being denied promotion to the post of Binder Gr. I only on the plea that the workmen junior to him as Binder Gr. II were promoted. The labour court returned the verdict against the appellant noting the applicable rules as per which Binder Gr. II who were having educational qualification of Class 8th pass became entitled to be considered for promotion after rendering 10 years service as Binder Gr. II and others after rendering 15 years. 3. The appellant had not passed Class 8th examination. Noting the rule and the award, vide impugned order dated 25/08/2000 the writ petition filed by the appellant challenging the award has been dismissed. 4. The facts not being in dispute, in view of the rule we concur with the award and the reasoning of the learned Single Judge. 5. The appeal is dismissed.
