JUDGMENT Mr. Inderjit Singh, J. - Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.39 dated 11.04.2017 under Sections 302, 148, 149 and 34 IPC, registered at Police Station Makhu, District Ferozepur as they have been summoned under Section 193 Cr.P.C. 2. Notice of motion was issued. Learned State counsel appeared and contested the petition. 3. I have heard learned counsel for the petitioners as well as learned State counsel and have gone through the record. 4. It has been brought to the notice of this Court that challan has already been presented and petitioners have been found innocent during investigation. Now, learned trial Court has summoned the petitioners under Section 193 Cr.P.C. 5. Further, no specific injuries have been attributed to the present petitioners. 6. The petitioners have already appeared before the trial Court in compliance of the order of this Court and they are regularly appearing before the trial Court. They are not required for investigation or custodial interrogation. They have only to face trial. No useful purpose will be served by sending the petitioners to custody. 7. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioners are entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and the order dated 26.03.2018 granting interim bail to the petitioners, is made absolute.
