JUDGMENT Mr. Hari Pal Verma, J. (Oral) - Prayer in the present petition filed under Section 439 of the Code of Criminal Procedure, 1973 is for grant of regular bail to the petitioner in case FIR No.205 dated 11.04.2018 under Section 306 IPC registered at Police Station Qila Panipat, Distt. Panipat. 2. Learned counsel for the petitioner submits that one of the sons of the petitioner namely Prateek is intellectually impaired, however, he is in custody since 21.06.2018. He submits that at best, it is a dispute regarding payment of money, if any, on account of some business transactions. 3. Learned State counsel, on instructions from ASI Hawa Singh, submits that the case is under investigation. There is a suicide note which mentions the name of the petitioner. In February 2013, there was marriage of daughter of the deceased Rajpal and he was badly in need of money but the petitioner who owed money to the deceased did not pay the money to him and thus, the deceased was under pressure. 4. I have heard learned counsel for the parties. 5. There is no allegation that the petitioner has compelled or abetted the deceased to commit suicide. Merely because there was outstanding amount against the petitioner, cannot be a reason to decline him bail at this stage. Therefore, I deem it appropriate to release him on regular bail. 6. Accordingly, the present petition is allowed and the petitioner is admitted on regular bail, subject to furnishing of her bail bonds/surety bonds to the satisfaction of trial Court.
