JUDGMENT : AMOL RATTAN SINGH, J. 1. Pursuant to the order dated 12.7.2018, learned counsel for the petitioner has produced in Court today an application annexing therewith a typed copy of a medico legal report dated 16.1.2018, showing the date of arrival of the patient to be 2.15 am on 16.1.2018, the first part of which reads as follows:- “External examination a scab of 8 cm x 8 cm and multiple small L.W. of various injuries are present over buttocks and over anal region. Pungent from smell is coming from the wound. Smell is like of burn wound. Outer scab is of yellow and reddish in colour and is like burn wound scab. Rectal penetration is painful and blood stained local tenderness present redness mild swelling present on anal opening. So painful defection.” 2. Even though the application is not numbered, it is taken on record with the Registry directed to give a number to the miscellaneous application. 3. The aforesaid wounds given in the medico legal report tally with the version of the complainant in the FIR. 4. Looking at the aforesaid facts, I see no reason to entertain this petition which is dismissed. 5. However, the observation made hereinabove as also in the earlier order passed on May 08, 2018, in CRM-M-16560-2018, shall only be construed to be an observation in the context of the petitions seeking bail under Section 439 Cr.P.C., with the trial to proceed against the petitioner and any co-accused wholly on the basis of evidence led before the trial Court.
