JUDGMENT Daya Chaudhary, J —As per case of the petitioner, order dated 17.09.2015 passed in CWP No.24551 of 2014 has not been complied with, whereas, it was to be complied with within a period of four weeks from the date of receipt of certified copy of the order and a direction was issued to grant all consequential benefits after granting the benefit of regularization in terms of policy applicable to the case of the petitioner. 2. When the order was not complied with, the petitioner has approached this Court by way of filing the present contempt petition. 3. In response to notice of motion, the reply has been filed, which is already on record. The claim of the petitioner has not been considered only because of interim order passed in case CWP No.17206 of 2014 titled as Yogesh Tyagi and another vs State of Haryana and others, whereas, learned counsel for the petitioner submits that LPA No.565 of 2017 was filed against the judgment of learned Single Judge and the same has been dismissed, still compliance of the order has not been made. It is also not disputed that against judgment of LPA Bench, no SLP has been filed. 4. However, the petitioner is entitled for the relief as granted by learned Single Judge which has further been upheld by LPA Bench. 5. In view of the above, the present petition is disposed of with a direction to the respondents to pass necessary orders in view of judgment of learned Single Judge passed in favour of the petitioner within a period of one month from the date of receipt of certified copy of the order. 6. However, in case, the issue is pending in Yogesh Tyagi's case , the order be passed subject to decision of said case. 7. In case, the said order is not complied with within the stipulated period, the petitioner is at liberty to move an application for revival of contempt petition. 8. The petition is disposed of accordingly.
