ORDER : VIJAY KUMAR VYAS, J. 1. Heard learned counsel for the petitioner as well as learned Public Prosecutor. 2. The vehicle in question - Maruti Suzuki Car Swift VXI No.RJ-25-CA-4909 is alleged to have been used by accused Golu Banjara, Bhoor Singh, Yogesh Kumar and Mastram for transporting opium, a contraband, on 14.10.2017. Investigation is complete. The accused in the instant matter have been bailed out. Application for taking the said vehicle on Sipurdginama was rejected by learned trial court on 02.11.2017 as the investigation had not concluded by then and certain questions were unanswered. 3. Since investigation is complete, charge-sheet has been filed, now, if the vehicle in question is not given on Sipurdginama to somebody, then definitely while standing idle its condition will be deteriorated and the vehicle may also become condemn. Since the petitioner is registered owner of the vehicle, she is ready to furnish Sipurdginama as well as surety bond and abide by condition/s, if any, imposed by this court. Therefore, it will be in the interest of justice that the vehicle in question be released on Sipurdginama. 4. Therefore, the criminal miscellaneous petition is allowed and the Maruti Suzuki Car Swift VXI No.RJ-25-CA-4909 seized in FIR No. 426/2017 registered at Police Station Bhimganj Mandi, Kota for offence under section 8/18 of NDPS Act and section 78 of Juvenile Justice (Care and Protection of Children) Act, 2015 be released on Sipurdgi if the petitioner submits a Sipurdginama of amount of Rs. 6,00,000/- and one surety of similar amount to the satisfaction of learned trial court on the following conditions : (i) She will not change its look in any manner; (ii) She will not sell/mortgage or alienate, in any manner, to any other person; and (iii) She will produce the vehicle as and when directed by the trial court. 5. The criminal miscellaneous petition is disposed of accordingly.
