ORDER : 1. Matter has come up on the misc. application filed by the petitioner seeking clarification of the order dt.08.12.2016. 2. Counsel submits that in compliance of order of the court dt.08.12.2016 the applicant was allowed to join the post of Instructor (Electric) and is presently discharging duties of the said post on which he was appointed on substantive basis but the fact is that one Hari Singh Gehlot who was appointed along with him and was lower in the order of merit is getting salary of Rs.63,869/- with Basic Pay Rs.25,650/-, at the same time, the applicant is presently getting a sum of Rs.45,641/- at least he is entitled to get the same salary of the Instructor (Electric) which he is holding in substantive capacity. 3. It is informed to this court that special appeal has been preferred by the State of Rajasthan against the order dt.08.12.2016, however, there is no interim order passed in the special appeal. 4. Since the special appeal is pending in this court, it may not be advisable for this court to make any clarification on the present misc. application. However, it will not preclude the applicant from filing misc. application in the pending special appeal. Accordingly, the instant misc. application stands disposed of in above terms.
