JUDGMENT Sanjay Karol, A.C.J —Sh. P. Mitra, Retired Chief Secretary to the Government of H.P. and Sh.Sunil Chaudhary, Secretary (GAD & SAD) to the Government of H.P., are present in Court. 2. As prayed for, names of respondents No.1 and 2 are directed to be substituted with Sh.Vineet Chaudhary, Chief Secretary to the Government of H.P. and names of respondents No.3 and 4 are directed to be substituted with Sh.Sunil Chaudhary, Secretary (GAD & SAD) to the Government of H.P. Registry is directed to make necessary corrections in the Memo of parties. 3. Having heard learned counsel for the parties, we are of the considered view that our judgment dated 27.05.2010, passed in CWP(T) No.8902 of 2008, titled as Sh.Nand Lal and others vs. State of H.P. and others, as also judgment dated 21.06.2012, passed in CWP No.6116 of 2011- G, titled as Nand Lal & others vs. State of Himachal Pradesh & others, are evidently clear. The cases of the original writ petitioners for promotion were to be considered on the basis of criteria prevalent as on the date, when the posts fell vacant, subject to the relaxation being granted in terms of the Rules with respect to the educational qualification. Abundantly, we clarify that in view of paras 8 and 9 of the judgment rendered in Nand Lal would mean that relaxation has to be with regard to the educational qualification. 4. Now at this stage, learned Advocate General, under instructions, from Sh.Sunil Chaudhary, Secretary (GAD & SAD) to the Government of H.P., states that the judgment in question shall positively be implemented within a period of two weeks. 5. In view of the same, present petition stands disposed of, reserving liberty to the petitioner to revive the same, if need so arises subsequently. Copy dasti.
