JUDGMENT Mr. Gurvinder Singh Gill, J. (Oral) - The petitioner seeks grant of regular bail in case registered vide FIR No.104 dated 24.05.2018 under Sections 406, 420 of Indian Penal Code, 1860 and Sections 13 of Punjab Travel Professional Act, 2014, registered at Police Station Adampur, District Jalandhar. 2. Mr. Harpal Preet Singh Chopra, Advocate puts in appearance on behalf of the complainant and has filed power of attorney, which is taken on record. 3. The FIR was registered at the instance of Jaspreet Singh wherein it has been alleged that Amandeep Singh, Parveen Kaur (petitioner) and Harjit Kumar used to visit his fast food shop quite often and represented that they could send the complainant and his brother abroad as they were into the said profession of sending people abroad and that they would get the work Visa for two years for Canada which would cost Rs.12 lakhs per person. It is alleged that being taken in by said representation, the complainant paid amount of Rs.22 lakhs in installments on different dates, but the accused neither sent them abroad nor returned back money. 4. Learned counsel for the petitioner submits that she has falsely been implicated in the present case and that in fact the co-accused Harjit Kumar has already been granted concession of regular bail by the trial Court itself and she is identically situated with Harjit Kumar as per the allegations levelled in the FIR. 5. On the other hand, learned State counsel while opposing the bail application has submitted that accused Amandeep Singh, who is husband of the petitioner is absconding and proceedings for declaring him proclaimed offender are pending and that he is involved in 6 identical cases whereas petitioner is involved in 2 identical cases. A prayer has thus been made for dismissal of the bail application. 6. Having considered the rival submissions addressed before this Court and bearing in mind the fact that the petitioner has been behind bars since last about 4 months and also that her case is identical with coaccused Harjit Kumar, who has already released on bail and also that she being lady deserves lienancy in the matter for grant of bail, the petitioner- Parveen Kaur is ordered to be released on regular bail on her furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Duty Magistrate Jalandhar. 7. 7. It is, however, clarified that none of the observations made above shall be taken to be an expression on merits of the main case. This petition stands accepted accordingly.
