JUDGMENT : P.D. Audikesavalu, J. This Public Interest Litigation has been filed by the Petitioner, who hails from Ayyampalayam Town Panchayat in Dindigul District. During the hearing on 30.11.2018, this Court had passed the following self-explanatory order in the matter:- “The Revenue Divisional Officer, Dindigul, convened a Peace Committee Meeting, to resolve the issue with regard to the supply of water to the Ayyampalayam, Town Panchayat and Sevugampatti Town Panchayat, in the District of Dindigul. A decision was taken to deepen the well dug originally by Ayyampalayam Town Panchayat and till the process is completed, it was resolved to permit the people of Ayyampalayam to draw water from the well dug by the Sevugampatti Town Panchayat. 2. It is the contention of the Petitioner that there is no water in the well dug by the Ayyampalayam Town Panchayat and as such, the decision taken by the Peach Committee Meeting should be implemented, meaning thereby, people of Ayyampalayam village should also be permitted to draw water from the well dug by the Sevugampatti Town Panchayat. 3. The Learned Additional Government Pleader on instructions, submitted that the arrangement in question was only an interim arrangement. According to the Learned Additional Government Pleader, the Ayyampalayam Town Panchayat has deepened its well and water is now available. 4. We direct the Revenue Divisional Officer, Dindigul, to inspect the well dug by the Fifth Respondent as well as the well dug by the Sixth Respondent along with the Assistant Director of Town Panchayat, Dindigul and submit a report as to whether water is available in the well dug by the Ayyampalaym Town Panchayat, for supplying water to the public of the said Panchayat, taking into account the contention of the Petitioner that there is no water. 5. Let a report be filed positively by 11 December, 2018.” 2. Today, Mr. D. Muruganantham, Learned Additional Government Pleader, appearing on behalf of the First to Fifth Respondents, on instructions, submits that in compliance of the aforesaid order passed by this Court, the Revenue Divisional Officer, Dindigul had inspected the site on 10.12.2018, and has found that the depth of the Ayyampalayam well had been deepened from 20 feet to 30 feet, which is more than that of the Sevugampatti well.
The Ayyampalaym well has a diameter of 40 feet and depth of 30 feet, while Sevugampatti well has a diameter of 25 feet and depth of 25 feet. It was found that that water was available at the depth of 20 feet in Ayyampalayam well and at the depth of 14 feet at Sevugampatti well. It is further informed that due to works relating to road expansion from Ayyampalayam section carried out by Highways Department, the water taps of Sevugampatti well had been destroyed and water could not be supplied from Sevugampatti well. It is further stated that the water level in Ayyampalaym well is more than that in Sevugampatti well and due to the recent rains, both wells have adequate water to meet the needs. It is also brought to notice that for Sevugampatti Town Panchayat, which comprises of seven villages, two infiltration wells and the newly constructed well are alone available for supplying water and that the two infiltration wells would get drained during summer and at that time, the newly constructed well alone would have to be used to supply water to the people of those villages. On the other hand, it is pointed out that inasmuch as the four wells of Ayyampalayam Town Panchayat are located on the eastern side of the dam, there would not be any interruption on the water supply to Ayyampalaym village even during summer. In these circumstances, it is reported that there would not be any damage to the Ayyampalayam well due to the Sevugampatti well. 3. Recording the same, we are of the view that no further adjudication is required in the matter, and the Writ Petition is disposed of accordingly. No costs.
