JUDGMENT Anubha Rawat Choudhary, J. – Heard Mr. Pravin Kr. Pandey, counsel appearing for the petitioner and Mr. Bhawesh Kumar, S.C. II assisted by Mr. Rahul Kamlesh, for the respondents. 2. The writ petition has been filed by the petitioner for direction upon the respondents to pay the amount of Rs. 6,38,440/- with statutory interest at the rate of 12% from the period of 22.01.2015 to till date in connection with the work done vide Agreement No. F2-01/2013-14 dated 03.09.2013 being the amount deducted by the respondent nos. 3 to 7 as penalty whereby alleging non completion of work by the petitioner within the stipulated time. 3. The counsel for the petitioner submits that the petitioner could not complete the work on time on account of non-payment of first bill and also on account of non-availability of sand. 4. Counsel for the petitioner, further, submits that a representation has been filed before the respondent no. 3 as back on 01.09.2013 as contained in Annexure-9 to the writ petition raising his grievance but till date no order has been passed on the said representation. 5. The counsel submits that he would be satisfied if a direction be issued to the respondent no. 3 to dispose of the said representation. 6. Considering the facts and circumstances of the case, the writ petition is disposed of with a direction upon the respondent no.3, The Managing Director, JIIDCO, Ranchi, to consider the grievance of the petitioner raised in the representation as contained in Annexure-9 to the writ petition and pass a reasoned order after hearing the petitioner within a period of three months from the date of production of a copy of this order. If any amount is found payable to the petitioner, the same should be paid to the petitioner within a period of one month thereafter. 7. It is made clear that this Court has not entered into the merits of this case. 8. With the aforesaid observations and directions, this writ petition stands disposed of.
