JUDGMENT 1. The petitioner is a resident of village Ganeshpura, Tehsil and Panchayat Samiti Khetri, District Jhujhunu. The village comes in the territory of Gram Panchayat Ranva, District Jhunjhunu. It is pleaded in the petition that the petitioner submitted a complaint on 16.06.2016 to the Divisional Commissioner, Jaipur, District Collector Jhunjhunu and the Chief Secretary, Government of Rajasthan giving information regarding the irregularities committed by Smt. Rekha Jewariya who was functioning as the Sarpanch of the Gram Panchayat. It is pleaded in the petition that taking cognizance of the complaint an enquiry was conducted and the Enquiry Officer submitted a report on 10.04.2017 (Annexure2) . The grievance is to no follow up action being taken pursuant to the report which on the face of it severely indicts the Sarpanch. We note that the Sarpanch has not been impleaded as a respondent. 2. Mr. D.V. Tholia, learned Additional Advocate General states that pursuant to the report necessary action has been contemplated to be taken against the Sarpanch and a show cause notice has already been issued to her to show cause as to why recovery be not made from her for the acts of misappropriation of funds. This statement is made by learned Additional Advocate General on instructions from Chief Executive Officer, Zila Parishad, Jhujhunu. The Chief Executive Officer states that a notice is proposed to be issued to the Sarpanch as to why she should not be removed. 3. Since the purpose of the Public Interest Litigation has been fulfilled, binding the respondents to the statement made today in Court and as recorded in the present order and with a hope that necessary action would be taken to its destination within reasonable time, we discharge the show cause notice issued in the writ petition and dispose of the same as infructuous.
