JUDGMENT : M.R. SHAH, J. 1. By way of this petition under Article 226 of the Constitution of India the petitioner has prayed for an appropriate writ, order or direction to quash and set aside the impugned order dated 05/10/2017 at Annexure G to the petition by which the petitioner is ordered to be blacklisted for a period of five years up to 25/10/2022. 2. Number of submissions have been made by the learned advocate appearing on behalf of the petitioner on the impugned order passed by the authority blacklisting the petitioner for a period of five years including that the impugned order is in breach of principles of natural justice. 3. After the matter was argued for some time, Shri Munshaw, learned advocate appearing on behalf of the respondents, under the instructions, has stated at the Bar that the impugned order dated 05/10/2017 is being withdrawn and a fresh order shall be passed after giving an opportunity to the petitioner and after following the principles of natural justice. He has stated at the Bar that such an exercise shall be completed at the earliest but not later than two months from today. 4. In view of the above, the impugned order dated 05/10/2017 stands withdrawn with a liberty in favour of the respondents – appropriate authority to pass a fresh order in accordance with law and on its own merits and after following the principles of natural justice. It is made clear that we have not expressed anything on merits in favour of either parties and the respondents – appropriate authority shall be free to pass appropriate order in accordance with law and on its own merits but after following the principles of natural justice. The aforesaid exercise shall be completed at the earliest. The petitioner is directed to cooperate with the appropriate authority. 5. With this, present petition stands disposed of.
