JUDGMENT 1. At domestic enquriy the enquiry Officer held the charge against the respondent to be proved. The charge was of taking money from the passengers and not issuing tickets. The report of the Enquiry Officer was adversely commented upon by the respondent to bring out procedural irregularities. The disciplinary authority held that the procedure followed by the Enquiry Officer was not correct and disagreeing with the findings as returned by the Enquiry Officer in view of evidence led and without issuing any Note of Disagreement, proceeded to hold the respondent guilty and levied penalty of stoppage of four annual grade increments with cumulative effect. 2. The penalty order dated 31.05.1995 was challenged by the workman before the labour Court which challenge was allowed. 3. The writ petition filed by the appellant has been dismissed by the learned Single Judge vide impugned order dated 10.01.2007 noting the facts as aforenoted by us. 4. Be that as it may, since none appears for the appellant at the hearing today the appeal is dismissed in default.
