ORDER 1. Appeal is admitted for final hearing. 2. At this stage, learned counsel for State appearing on advance copy accepts notice of the appeal, therefore, no further notice after admission is required to be issued. 3. Also heard on IA No. 4059/2018. 4. This is an application for suspension of custodial sentence awarded to appellant No. 2 Yogesh. 5. Appellant No. 2 stands convicted for offences punishable under section 302/34 of IPC and section 25(1b)(b) of Arms Act and has been sentenced to undergo R.I. for life. 6. Learned counsel for appellant No. 2 submits that his name was not mentioned in the FIR and in the merg intimation and after three days his name was disclosed in the case diary statement, after the main witness Salman (PW1) read it in the newspaper. The allegation against the appellant No. 2 is that he caught hold the deceased while Shahbaz, the main assailant (who died during the pendency of trail) caused the fatal injury. 7. The bail application is opposed by counsel for State by filing written objection. He invited out attention to the evidence of Salman (PW1). 8. After having heard rival submissions and considering the evidence that has come on record, we are of the considered opinion that application for suspension of custodial sentence deserves to be allowed and it is hereby allowed. 9. It is directed that the custodial sentence alone awarded to appellant No. 2 Yogesh shall remain suspended subject to his furnishing a personal bond in the sum of Rs. 30,000/- (Rs. Thirty Thousand only) with one surety in the like amount to the satisfaction of the trial Court for his appearance in the trial Court on 11.10.2018 and shall continue to do so on all such future dates as may be fixed in that behalf during the pendency of appeal. 10. Accordingly, IA No. 4059/2018 stands allowed and closed. 11. Office is directed to process the matter to be listed for final hearing in due course of time at its own turn. 12. Let a copy of this order be forwarded to the trial Court for information.
