JUDGMENT Mr. Arvind Singh Sangwan, J. (Oral):- Prayer in this petition is for grant of regular bail to the petitioner incase FIR No.155 dated 08.06.2017 under Sections 148, 149, 323, 325, 365,506, 307, 216 read with Section 120-B of IPC, registered at Police StationSadar Narnaul, District Mahendergarh, Haryana. 2. Counsel for the petitioner submits that the petitioner was grantedbail when the FIR was registered and later on when Section 307 was added, thepetitioner was re-arrested. Counsel for the petitioner further submits that co-accusedDharender son of Basti Ram against whom there are allegations ofconspiracy and Deepak @ Munna son of Roshan Lal have already been grantedthe concession of regular bail by the Additional Sessions Judge, Narnaul videorder dated 03.08.2017. 3. Counsel for the petitioner also submits that the petitioner after hisarrest is in judicial lockup since 05.08.2017 and the report under Section 173Cr.P.C. has already been presented and it will take long time in conclusion oftrail. 4. Learned State counsel on instructions from HC Kuldip Singh has however opposed the bail on the ground that the complainant has sufferedseveral fractures in the occurrence and one of the injury has been declareddangerous to life 5. Without commenting anything on the merits of the case, considering the fact that the petitioner is in judicial lock up since 03.08.2017;investigation is complete and challan has been presented as well as chargeshave been framed and prosecution evidence is yet to start; two of the co-accused have been granted the concession of regular bail, the petitioner isordered to be released on bail subject to his furnishing bail bonds/surety bondsto the satisfaction of the trial Court/Illaqa Magistrate. However, subject to deposit of Rs. 25,000/- with the trial Court/Illaqa Magistrate, which will behanded over to the complainant without prejudice to the right of the petitionerduring the course of the trial. 6. Disposed of.
