JUDGMENT : Counsel for the petitioner is absent. 2. Heard Mr. A. Allam, Sr. counsel assisted by Ms. Nehala Sharmin, counsel appearing on behalf of the respondents. 3. Counsel for the respondents submits that the writ petition has been filed for restraining the respondents from withholding petitioner’s salary from the salary account of the petitioner. The petitioner is an employee of Bokaro Steel Plant. Counsel for the respondents pointed out that the recovery from the salary of the petitioner was done pursuant to order passed by Debt Recovery Tribunal, Ranchi and as on date the entire dues of the bank has been realized. 4. Counsel for the respondents draws the attention of this Court to affidavit dated 12.01.2018 wherein it has been specifically mentioned that the recovery has been made under the orders of Debt Recovery Tribunal, Ranchi and the recovery certificate of Rs.13,66,174.95 and further cost of Rs. 16,000/- was issued against the certificate debtors including the petitioner in O.A. Case No. 97 of 2011. It has been mentioned in this affidavit that on 17.12.2017 the bank informed the petitioner that the bank has already released the balance amount after retaining a sum of Rs. 3,70,000/- against the account of the petitioner. So after retaining Rs. 3,70,000/- the petitioner may withdraw the remaining balance amount from this account. Subsequently bank has also informed the petitioner on 03.01.2018 to take back his remaining balance amount if he so desires. 5. In view of these submissions, counsel for the respondents submits that the writ petition has become infructuous. Considering the submissions made on behalf of the Respondents it appears that nothing survives in this writ petition and the writ petition has become infructuous. Accordingly the writ petition is dismissed. Petition dismissed.
