JUDGMENT & ORDER : 1. Heard Mr. A. Deb, learned counsel for the petitioner. Also heard Mr. D. Chakrabarty, learned counsel appearing for the respondent. 2. This petition has been filed by the wife seeking transfer of Misc. (G) Case No. 72/2017 pending in the Court of the learned Principal Judge, Family Court, Kamrup (M) at Guwahati to The Court of the learned Dist. Judge, Hojai at Sankardev Nagar, Assam. 3. Mr. Deb submits that the divorce case filed by the respondent-numbered as F.C (Civil) No. 218/2017, has already been transferred from the court of learned Principal Judge, Family Court, Kamrup (M) at Guwahati to the Court of the learned Add. Dist. Judge, Hojai at Sankardev Nagar, Assam, by order dated 21.12.2017 passed in T.P. (C) No. 39/2017 and since the present proceeding arises out of an application seeking guardianship of the minor daughter by the sole respondent, a similar order be passed transferring the aforesaid case also to the Court of the learned Addl. Dist. Judge, Hojai at Sankardev Nagar, Assam. 4. Mr. Chakrabarty submits that he has no objection if the prayer is allowed since the main divorce proceeding has already been transferred. In view of the above and considering the grounds mentioning in the application, I find that the present is a fit case to allow the prayer made by the petitioner. 5. It is accordingly ordered that Misc. (G) Case No. 72/2017 filed U/S 7 of the Guardians and Wards Act, 1890, pending in the Court of the learned Principal Judge, Family Court, Kamrup (M) at Guwahati, shall stand transferred to the Court of the learned Addl. Dist. Judge, Hojai at Sankardev Nagar, Assam. On transfer of the proceeding the same shall be re-numbered. Parties to appear before the Court of learned Addl. Dist. Judge, Hojai at Sankardev Nagar, Assam on 07.05.2018. 6. This petition stands disposed of.
