JUDGMENT Mr. Tejinder Singh Dhindsa, J.: (Oral) - Petitioner seeks benefit of regular bail pending trial in case FIRNo.58, dated 19.01.2017, under Sections 302/120-B IPC, registered atPolice Station DLF, Sector-29, District Gurugram. 2. Counsel for the parties have been heard. 3. Deceased in the present case is Bijender. FIR came to beregistered on the disclosure statement of Sandeep i.e. husband of thepetitioner. As per statement of Sandeep, Bijender was done to death on23.12.2016 by inflicting axe blows. In other words, Sandeep is the mainaccused in the matter. The motive behind the occurrence is that deceasedBijender, who was the brother-in-law of Sandeep had entered into forcibleillicit relations with the present petitioner and which development had beendisclosed to Sandeep but keeping in view the close proximity between theparties, Sandeep had kept quite on the issue for a certain length of time. 4. Present petitioner, who is a lady carrying a minor child wasarrested on 27.03.2017. Even as per prosecution, petitioner has been ropedwith the aid of Section 120-B IPC. No specific injury on the person ofdeceased Bijender has been attributed to the present petitioner. 5. Investigation having been completed, challan was presentedand charges have been framed. State Counsel informs the Court that out of29 prosecution witnesses cited only 7 have been examined till date. 6. The trial, as such, would take time to conclude. 7. Without making any observations on merits and keeping inview the peculiar circumstances noticed herein above, petitioner is heldentitled to the benefit of bail. 8. Petition is allowed. 9. Petitioner be enlarged on bail subject to satisfaction of the trialCourt/Duty Magistrate, Gurugram.
