JUDGMENT Anubha Rawat Choudhary, J. – Heard Mr. K.M. Joseph, learned senior counsel appearing for the petitioner assisted by Mr. Chandrajit Mukherjee, Advocate. 2. Heard Ms. Kanchan Kumari, counsel appearing on behalf of the respondent-state and Mr. Bal Krishna Mishra, counsel appearing on behalf of respondent no. 4. 3. At the outset, counsel for the respondent submits that the writ petition is not maintainable in view of the provisions of appeal against the impugned order under Section 15 of the Jharkhand Educational Tribunal, Act 2005. 4. Upon this, counsel for the petitioner seeks permission to withdraw this writ petition with liberty to file appropriate appeal under the provisions of Section 15 of the Jharkhand Educational Tribunal, Act 2005. He submits that the appeal will be filed within a period of four weeks from today. 5. Considering the prayer made by the counsel for the petitioner for withdrawal of the writ petition, this writ petition is dismissed as withdrawn with the liberty to the writ petitioner to file appropriate appeal within a period of six weeks from today. 6. Pending I.A. No. 8802 of 2017 stands disposed of.
