JUDGMENT : Pankaj Bhandari, J. Petitioners have filed these bail applications under section 439 of Cr.P.C., 1973 2. F.I.R. No. 207/2017 was registered at Police Station Raipur, District Jhalawar for offence under Section 8/15 of N.D.P.S. Act. and Section 3/25 of Arms Act. 3. It is contended by Counsel for the petitioners that from petitioner Bhajnaram 45 Kg. poppy husk and from petitioner Harjinder Singh 37 Kg. poppy husk was recovered which individually is less than commercial quantity. 4. It is also contended that samples were not taken in accordance with law. 5. Learned Public Prosecutor has opposed these bail applications. 6. I have considered the contentions. 7. Considering the contentions put forth by Counsel for the petitioners, I deem it proper to allow these bail applications. 8. These bail applications are accordingly allowed and it is directed that accused-petitioners shall be released on bail provided they furnish a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 9. A copy of this order be placed in each connected file.
