JUDGMENT : 1. Through the instant writ petition, petitioner seeks the following relief:- “Writ of mandamus commanding and directing the respondents particularly the respondent No. 2 to accord registration in favour of petitioner Unit having completed all the requisite formalities.” 2. Despite directions, respondents have not filed any objections. 3. The case of the petitioner is that he being desirous of setting Stone Crusher at Khasra No. 508, Village Korpunnu,Tehsil Hiranagar, District Kathua and earn his livelihood from the said Unit. It is stated that petitioner identified suitable piece of land and then applied for issuing of No Objection Certificates (NOCs) to the concerned departments. After obtaining the NOCs from all the departments, petitioner submitted the same to the respondent No. 2-General Manager, DIC Kathua for registration so that the Unit could be made operational. It is stated that respondent No. 2 has acknowledge and accepted all the NOCs, however, has started finding faults with the No Objections Certificates. It is further stated that No Objection Certificate issued by the Dy. Commissioner, Kathua dated 09.09.2017 is clear and categoric and states that the land is duly owned by the petitioner and that it is thoroughly away from all the health institutions. It is stated that the excuse being found by the respondent No.2 is that the nature of the land is Banjar Jadeed and not Banjar Qadeem. 4. Learned counsel for the petitioner states that petitioner-Unit fulfils all the eligibilities as required for the establishment of the unit in question, as such, respondent No. 2 be directed to grant registration for commencement and continuation of the Unit. 5. During the course of the arguments, learned counsel for the petitioner submitted that the petitioner would feel satisfied, if the respondents are directed to consider the claim of the petitioner for grant of registration in favour of the petitioner-Unit within some stipulated time. Submission made is considered. There is no legal impediment in granting such relief. 6. Mr. F. A. In view of the aforesaid submissions made by the learned counsel for the petitioner and in the facts of the case, I deem it appropriate to dispose of the instant writ petition with a direction to the respondent No. 2 to consider the claim of the petitioner-Unit for grant of registration in favour of the petitioner- Unit, if he qualifies the conditions. This exercise shall be carried out expeditiously, preferably within a period of six weeks from the date of receipt of a certified copy of this order. 8.
