JUDGMENT Vivek Singh Thakur, J —This petition has been filed against impugned order dated 24.2.2018 passed by Judicial Magistrate 1st Class, Court No. 2, Paonta Sahib, District Sirmour, H.P., whereby right of petitioner to lead defence evidence has been closed, as the petitioner had failed to lead his evidence despite granting sufficient opportunities. 2. In the petition, not even a single word has been uttered for reasons not to lead evidence on the part of petitioner on various dates fixed for the said purpose in the trial Court. Even the zimini orders of the said dates have not been placed on record, which may have reflected the cause, if any, for not leading evidence before the trial Court. 3. At this stage, learned counsel for the petitioner submits that it has been informed by petitioner to him after filing of the petition that only one witness namely Dalip Singh is to be examined as defence witness and the petitioner could not produce him as he was not available on those dates and therefore, he prays that one opportunity may kindly be granted to petitioner to examine the said Dalip Singh. 4. In my opinion, issuance of notice to respondent for filing his response to the petition will cause unnecessary delay in the proceedings pending before the trial Court, beside causing unnecessary financial burden upon the respondent. Therefore, without issuing notice to respondent, one opportunity to examine the aforesaid Sh. Dalip Singh is granted to petitioner, subject to payment of costs of Rs. 5,000/- to the respondent/complainant Raghubir Singh on the next date of hearing i.e. 16.4.2018 fixed before the trial Court. 5. Learned counsel for the petitioner undertakes to supply the copy of this order to the opposite counsel on or before 13th April, 2018, so as enabling him to prepare for cross-examination of witness and the witness shall be examined on 16th April, 2018, the date already fixed before the trial Court, by producing him on self responsibility, failing in which no further opportunity shall be granted for the said purpose and the trial Court will proceed further in accordance with law. The petition is disposed of in the aforesaid terms. Copy Dasti.
