JUDGMENT Dharam Chand Chaudhary, J —In this petition a direction has been sought to be issued to the respondents to issue OBC certificate to the petitioner on the grounds inter alia that Gram Panchayat Juddu-Shilal under Development Block, Chopal, District Shimla has been declared backward and the entries qua the family of the petitioner against Sl. No. 221 in the Panchayat record has been recorded as belonging to backward class community. 2. In reply to the writ petition, the stand of the respondent-State is that in Sajra Nasab for the year 1951-52, there is nothing that the caste of the petitioner''s family is Brahaman and sub-caste ''Sarswat'', however, in the subsequent Sajra Nasab for the year 1961-62, 1970-71 and 1996-97, though the family is recorded as Brahaman, but its sub-caste does not find mention therein. Now after the settlement operation while the caste of the petitioner has been record in revenue record as Brahaman, his sub-caste is Angiras. Therefore, the certificate cannot be issued. 3. The reply is not suggestive of that the inquiry has been conducted in the matter and it is thereafter a decision taken that the family of the petitioner is not covered under backward classes. The representation Annexure P-4 to the writ petition also seems to be not responded by the respondent as yet. Therefore, the writ petition is disposed of with a direction to the respondents to consider the representation Annexure P-4 of the petitioner within three months and take a conscious decision as to whether the petitioner belongs to Other Backward Classes or not, after affording an opportunity of being heard to all concerned. If he is found to be a member of Other Backward Classes, to issue certificate to him accordingly. Pending applications, if any, shall also stand disposed of.
