ORDER 1. This appeal under section 173 of the Motor Vehicles Act is arising out of the award dated 17.10.2015 passed in Claim case No. 305/2013 by II MACT, Jaora, District Ratlam seeking enhancement in a death case where one Madanlal succumbed due to injuries sustained by him in a motor accident which took place on 8.9.2013. 2. The date of accident, negligence and the issue of liability is not in dispute, however, the finding recorded by the Claims Tribunal in this regard is not in question. 3. Learned Tribunal after assessing the income of the deceased @ Rs. 4,000/- and deducting1/5th towards personal expenses, applying the multiplier of 13, awarded a sum of Rs.4,99,200/-, break-up of which is as under : Towards loss of earning Rs. 4,99,200/- Towards funeral expenses Rs. 25,000/- Towards consortium Rs. 1,00,000/- 4. Learned counsel for the appellants contends that compensation as awarded by the Tribunal accepting earning of the deceased as Rs. 4,000/- is inadequate looking to the fact that he was working as labourer and in other heads like loss of love and affection and loss of estate, no amount has been awarded. However, accepting the earning as Rs. 5,000/- per month and adding future prospects, applying adequate multiplier, the reasonable amount of compensation may be awarded. 5. On the other hand, learned counsel for the Insurance company contends that the Tribunal has rightly awarded the compensation and argued in support of the findings recorded by the Tribunal. 6. After hearing learned counsel appearing on behalf of both the parties, this court is of the view that earning of the deceased should be taken as Rs. 5,000/- per month. After deducting 1/4th towards personal expenses, applying the appropriate multiplier, then in such circumstances the enhanced amount comes to Rs. 85,000/-. 7. Accordingly, this appeal is allowed in part. The enhancement of Rs. 85,000/- is directed in addition, as already awarded by the Claims Tribunal. The enhanced amount shall carry interest @ 7% per annum from the date of filing of the claim petition till its realÁation. The appellant is also entitled for the cost.
