ORDER : Pankaj Bhandari, J. Petitioner has filed this bail application under section 439 of Cr.P.C., 1973 2. F.I.R. No. 516/2017 was registered at Police Station Karni Vihar, Jaipur for offence under Section 8/20 of the NDPS Act. 3. It is contended by counsel for the petitioner that as per the definition of gaanja given in the NDPS Act, 1985, it is the flowering or fruiting tops of the cannabis plant (excluding the seeds and leaves when not accompanied by the tops). 4. It is contended that Counsel for the petitioner has placed reliance in 2005(1) R.C.C. 523; "Navla v. State of Rajasthan", wherein the Court has held that recovery of leaves would not fall within the definition of gaanja. It is contended that recovery memo in this case reveals that only leaves type substance was recovered from different bags. 5. Learned Public Prosecutor has opposed the bail application. 6. I have considered the contentions. 7. Considering the contentions put forth by counsel for the petitioner, I deem it proper to allow the bail application. 8. This bail application is accordingly allowed and it is directed that accused petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs. 50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
