JUDGMENT 1. This appeal by the claimants under Section 173(1) of Motor Vehicles Act arises out of award dated 19.11.2014 passed by Member, VI Additional Motor Accident Claims Tribunal, Indore in Claim Case No. 566/2012 seeking enhancement of compensation. 2. The date of accident, negligence and the issue of liability is not in dispute, however, the finding recorded by the Claims Tribunal in this regard is not in question. As per the finding of the Tribunal for the death of Badrilal Chouhan, an unskilled labourer, the amount of compensation has been allowed with the following break up : Loss of earning Rs. 4.05,000/- Funeral expenses Rs. 25000/- Loss of estate Rs. 3000/- Loss of love and affection Rs. 20000/- Loss of consortium Rs. 100000/- Total Rs. 5,53,000/- 3. Learned counsel for the appellants contends that the compensation as awarded by the Tribunal accepting earning of Rs. 3000/- per month is inadequate looking to the date of accident that he is working as an unskilled labourer, however, accepting the earning as Rs. 4000/- per month and adding future prospects, applying adequate multiplier, the reasonable amount of compensation may be awarded. 4. On the other hand, learned counsel for the Insurance Company contends that the Claims Tribunal has rightly awarded the compensation and argued in support of the findings recorded by the Tribunal. 5. After hearing the learned counsel appearing for the parties and on perusal of the facts of the present case and accepting the earning as proposed, in my considered opinion, a lump sum amount of Rs. 1,20,000/- (Rupees One Lac Twenty Thousand Only) deserves to be enhanced in addition to the amount as awarded by the Claims Tribunal. 6. Accordingly this appeal is hereby allowed in part. The enhancement of Rs. 1,20,000/- (Rupees One Lakh Twenty Thousand Only) is directed in addition to the amount of compensation awarded by the Tribunal. The enhanced amount shall carry interest @7% per annum from the date of filing of the claim petition till its realÁation.
