ORDER : C.A. No.355 of 2018: We have heard learned counsel for the parties. The impugned order is modified to the extent that the appellant will pay a sum of Rs.37,07,996/- (Rupees Thirty Seven Lakhs Seven Thousand Nine Hundred Ninety Six) with 6% interest from 22.09.1997 till the payment within three months from today. Thereafter, for the delayed period, rate of interest will be 10% per annum. The appeal is disposed of in above terms. C.A. No. 356 of 2018: In view of order passed in C.A. No.355 of 2018, the appellant – original defendant No.2 will have no further liability. The appeal is disposed of accordingly.
