JUDGMENT : MAHABIR SINGH SINDHU, J. 1. The present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.0109 dated 02.03.2017 registered under Sections 406, 420 and 506 of the Indian Penal Code at Police Station Gharaunda, District Karnal. 2. It is contended by learned counsel for the petitioner that the petitioner was only the driver in the diary run by the co-accused Sandeep @ Mota and Jaibir and he has nothing to do with the sale and purchase of milch animals. It is further contended that investigation in this case qua the petitioner is already complete and his custody will not serve any purpose. The petitioner is in custody since 20.12.2017. 3. Learned State counsel on instructions from ASI Balwan Singh has acknowledged that the investigation qua the petitioner is already complete and report under Section 173 Cr.P.C. is likely to be submitted within a week. 4. In view of the fact that the petitioner is only the driver of the co-accused and no useful purpose would be served by keeping the petitioner behind the bars any more. Therefore, in view of the above said circumstances, without expressing any opinion on the merits of the case, this petition is accepted. Petitioner-Mohit Sharma be admitted to bail on his furnishing bail bonds and surety bonds to the satisfaction of the learned trial Court. 5. In compliance of order dated 01.02.2018, ASI Balwan Singh-Investigating Officer again assures the Court that needful shall be done within two weeks. After doing so, compliance report be submitted to this Court on or before 12.03.2018.
