ORDER 1. The present petition has been filed by the petitioners under Article 227 of the Constitution of India against the order dated 15.10.2013 passed by the Board of Revenue. 2. Learned counsel for the petitioners has submitted that the petitioners are the legal representatives of the original non-applicant Smt. Aanima Choubey, who died on 13.2.2013 and in the Board of Revenue Smt. Anima Choubey was proceeded ex parte on 4.7.2013 and thereafter the impugned order has been passed on 15.10.2013 observing that the respondents had remained absent despite the notice. 3. Learned counsel for the petitioners has submitted that the petitioners are the married daughters of Smt. Anima Choubey and it was the duty of the present respondent No. 3, the applicant before the Board of Revenue to array them as the party respondents soon after the death of Smt. Anima Choubey. In these circumstances, the counsel has submitted that the impugned order may be quashed. 4. On the other hand the learned counsel for respondent No. 3 has submitted that even the respondent No. 3 was not aware about the death of Smt. Anima Choubey. 5. In the circumstances, this Court is of the considered opinion that the respondent No. 3 ought to have impleaded the petitioners before the Board of Revenue, hence, the order dated 15.10.2013 passed by the Board of Revenue is hereby quashed and the matter is remanded back to the Board of Revenue and the respondent No. 3 is directed to file an appropriate application for bringing the present petitioners as legal representatives of Smt. Anima Choubey on record before the Board of Revenue on the next date of hearing. The parties are directed to make their presence before the Board of Revenue on 23.1.2018 and the Board of Revenue shall pass the order in accordance with law.
