JUDGMENT : BISWANATH SOMADDER, J. 1. Let a copy of the receipt issued by the State Legal Services Authority, West Bengal, indicating payment of costs in terms of the order dated 14th November, 2018, be taken on record. 2. Let a report in the form of a supplementary affidavit filed in Court today be also taken on record. 3. Having heard the learned advocates for the parties and upon perusing the papers including the report in the form of an affidavit which was filed earlier on behalf of Howrah Municipal Corporation as well as the report contained in the supplementary affidavit filed in Court today, it is clearly evident that there exists a private dispute with regard to the ownership as also tenancy of the premises-in-question. 4. We notice that there are at least three civil suits subsisting between the parties and resolution of these civil disputes which are essentially factual in nature cannot be short-circuited by using the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India since any order passed in the writ proceedings will tantamount to deciding the fate of the civil litigations pending between the parties. 5. That apart and in any event, in an Intra-Court Mandamus Appeal, no interference is usually warranted unless palpable infirmities of reasoning or perversities are noticed on a plain reading of the impugned judgment and order. 6. We do not notice any such palpable infirmity or perversity on a plain reading of the impugned judgment and order. The impugned judgment is supported with cogent and justifiable reasons. Its correctness, therefore, cannot be open to further scrutiny within the limited scope of an Intra-Court Mandamus Appeal. 7. For reasons stated above, the appeal and the connected application are liable to be dismissed and stand accordingly dismissed. 8. We, however, make it clear that dismissal of the present appeal and the connected application shall not prejudice the rights of the appellant in any manner in respect of the civil proceedings pending before the learned Courts below. 9.
