JUDGMENT : 1. Shri Navneet Kishore, learned counsel for the applicants. Shri Bhuwan Gautam, learned Public Prosecutor for the non-applicant- State. Heard. Perused the case diary. 2. This first application under section 439 of Criminal Procedure Code for grant of bail has been filed by the applicants-Kamal s/o Basant Singh and Sure Singh s/o Devaji, who are implicated in Crime No. 215/2018 registered at Police Station–Tarana, District Ujjain for the offence punishable under sections 307, 341, 323, 294, 506 and 34 of the Indian Penal Code and are in custody since 21-8-2018. 3. On due consideration of the statement of injured Mahendra and complainant Bharat so also the fact that Sure Singh was armed with Lathi and inflicted injury to them and the injuries sustained by the injured are simple in nature, material evidence available in the case diary and the period of custody of the applicants, without expressing any opinion on the merits of the case, I allow this bail application and it is directed that the applicants-Kamal & Sure Singh shall be released on bail subject to their furnishing a personal bond in the sum of Rs. 40,000/- (Rupees Forty thousand only) each with two local sureties each in the like amount to the satisfaction of the concerned JMFC/CJM for their regular appearance before him or trial Court on all dates of hearing as may be fixed in this behalf by the Court concerned during trial. It is also directed that the applicants shall abide by all the conditions enumerated under section 437(3) of the Criminal Procedure Code. 4. A copy of this order be sent to the Court concerned for compliance. 5. M.Cr.C. No. 37312/2018 is allowed and stands disposed of. Certified copy as per rules.
