A.MUHAMED MUSTAQUE

body2018
JUDGMENT : A MUHAMED MUSTAQUE, J. 1. Petitioner passed Bachelor of Science in Cardiac Perfusion Technology from the Amrita Vishwa Vidyapeetham University, a Deemed University. 2. The petitioner applied for equivalency certificate from the first respondent and that application is pending. On account of non-consideration of the same, the petitioner has approached this Court. 3. The learned Standing Counsel submitted that pass criteria stipulated by the first respondent University is different from that of Amrita Vishwa Vidyapeetham University. As per the Kerala University of Health Sciences Regulations, a minimum of 50% marks are required to pass such course and whereas in the regulations of Amrita Vishwa Vidyapeetham University there is no such stipulation of 50% marks. Difference in pass criteria cannot be a reason to deny the equivalency certificate. Each university may have its own standards of assessment of examination, that cannot be a reason for pendency in consideration and issuance of equivalency certificate. 4. Having heard both sides, there shall be a direction to the University to consider petitioner's request for equivalency certificate, without any insistence regarding stipulation of pass criteria, forthwith. The writ petition is disposed of as above
