ORDER : Report No. 118 of the Monitoring Committee dated 7th May, 2018 1. Learned amicus curiae has placed before us Report No. 118 given by the Monitoring Committee. 2. This Report deals with alleged unauthorised constructions in Khan Market as well as in Sanjay Market. 3. With regard to the allegations made pertaining to Sanjay Market, it has also been pointed out that the seals of the premises sealed on 2nd August, 2007 have since been tampered with and huge multi storeyed buildings have come up on all the sealed premises. Even some of the premises have been converted to residential premises. 4. According to learned amicus curiae, this amounts to perjury and contempt of the orders of this Court. 5. We have no doubt that the Special Task Force will act in accordance with the orders passed by this Court and in accordance with law both with regard to Khan Market and Sanjay Market. 6. We also make it clear that if there are any other areas where there are violations which have come to the notice of the Monitoring Committee, they may be sent directly to the Special Task Force and learned Additional Solicitor General assures that the Special Task Force will act on all these suggestions and complaints. 7. For the purpose of the accountability, we expect the Special Task Force to meet once in a fortnight along with concerned officials of the various corporations and the Zonal authorities to ensure that the orders of this Court are implemented in letter and spirit. The minutes of such meetings which are held every fortnight should be assiduously kept and handed over to learned Additional Solicitor General so that there is accountability and monitoring all the progress that is made. Status of Ground Water Status of ground water levels has been filed by the Central Ground Water Board in compliance with the order dated 24.04.2018. The Report is of May, 2018. 2. A perusal of the Report, which needs to be studied in greater depth, indicates an extremely sad state of affairs. 3.

The conclusion given is as follows: “Analysis of long term water level data of May 2000 to present period of May 2017 reveals that over the period, in areas categorized as Over Exploited as per Ground Water Resources Estimation of 2013, mostly in South, South East, New Delhi, East, North, North East, and also parts of West and South West district of Delhi State, water level declined rate varied from 0.5 m/year to more than 2 m/year at places. There are some pockets, where change in water level is not significant or remained unchanged. Such pockets of shallow and rising water level areas are diminishing over the period. As such, major part of State is under Overexploited and Semi Critical category and in such areas water levels are showing persistent declining trend during last two decades.” 4. It is quite clear that there is over-exploitation of ground water in South District, New Delhi District, South East District, East District, Shahadara, North East District and almost rest of Delhi is in a semi-critical state. There are only some pockets in West District and Central District which appear to be safe as of now. 5. We can only urge the concerned authorities dealing with governance of Delhi to look into the Report of the Central Ground Water Board to avoid a water crisis. 6. The Secretary in the Ministry of Water Resources of the Government of India and the Delhi Government as well as the Delhi Pollution Control Committee should tell us about one week before the next date of hearing of the possible solutions. 7.
