JUDGMENT : MAHABIR SINGH SINDHU, J. 1. Present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.121 dated 04.10.2017, registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short 'NDPS Act' at Police Station Sadar Nawanshahr. 2. It is contended by learned counsel for the petitioner that contraband recovered from petitioner i.e. Pheniramine male ate (Ex-I) is not covered under the provisions of NDPS Act. On a specific query, learned State counsel supplied the report dated 16.02.2018 received from the District Drugs Inspector, Shaheed Bhagat Singh Nagar, Punjab and fairly stated that above said contraband is not covered under the provisions of the NDPS Act. 3. Keeping in view the fact that the above contraband in the present case is not covered under the provisions of NDPS Act and the final conclusion of trial is to take a long time, it would be just and appropriate if the concession of bail is granted to the petitioner. Moreover, the petitioner is in custody since 04.10.2017 and no useful purpose would be served by keeping him behind the bars. Therefore, in view of the above-said circumstances, without expressing any opinion on the merits of the case, this petition is accepted. Petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of the learned trial Court.
