JUDGMENT Mr. H.S. Madaan, J.:- This petition for regular bail has been filed by petitioner RanjitSingh, an accused in F.I.R. No. 195 dated 1.10.2017 for offence underSection 15 of the NDPS Act registered with Police Station Babain, DistrictKurukshetra. 2. The brief facts of the case are that on 30.9.2017 in the area ofBrara Chowk, petitioner was found in possession of 9.500 Kg. of poppyhusk. At that time, he was being accompanied by his wife Rajwinder. Bothof them were arrested in this case and have been challaned and now they arefacing trial before Judge, Special Court, Kurukshetra. 3. The petitioner had moved an application for bail before Judge,Special Court, Kurukshetra but the same was dismissed vide order dated28.11.2017. As such, he has approached this Court praying for grant ofsimilar relief. 4. This petition is resisted by the State counsel. 5. I have heard learned counsel for the petitioner, learned Statecounsel besides going through the record. 6. As per custody certificate filed by the State counsel, thepetitioner is in custody for more than three months. He is shown to beinvolved in another criminal case. Though in the order passed by theAdditional Sessions Judge, it is mentioned that he has been convicted incase F.I.R. No. 109 dated 26.4.2012 under NDPS Act, Police Station Sadar Thanesar and was sentenced to undergo imprisonment for a period of oneyear. Wife and co-accused of the petitioner Rajwinder has since beenreleased on bail. 7. The trial is likely to take some time. Without expressing anyopinion on the merits of the case, I find that it would be in fitness of thingsif the present petition is allowed. The petitioner is ordered to be released onbail on furnishing bail bond and surety bond to the satisfaction of Judge,Special Court, Kurukshetra subject to the following conditions : - (i) He shall appear in the Court on each and every date ofhearing. (ii) He shall not give any threat or intimidation to theprosecution witnesses. (iii) He shall not leave India without prior permission of theCourt. 8. In addition to that the trial Court may impose any term andcondition found suitable to ensure that the petitioner does not abscond andinterfere in the trial. 9. In case the petitioner violates any term and condition on whichthe bail has been granted to him, the prosecution would be entitled to apply for cancellation of bail.
