JUDGMENT/ORDER : 1. This petition has been filed by the petitioner for grant of emergent parole for a period of 30 days on the ground of marriage of his brothers namely; Latif Khan and Naseeb Khan (Sameer), which is going to solemnise on 08.04.2018. 2. Contention of learned counsel for the petitioner is that petitioner is serving sentence of life imprisonment in Central Jail, Jaipur. D.B. Criminal Appeal preferred by petitioner against the judgement of conviction and sentence is pending before this Court. Petitioner was earlier released on parole for a period of 20 days on 02.06.2017 by the Superintendent, Central Jail, Jaipur. 3. It is contended that marriage of petitioner's brothers namely; Latif Khan and Naseeb Khan (Sameer) is going to solemnise on 08.04.2018. Petitioner is elder brother in the family and his parents are old aged so his presence is necessary for the aforesaid occasion. There is even no complaint against him by the authorities. Hence this petition for emergent parole. 4. Shri B.N. Sandu, learned Additional Advocate General opposed the petition and submits that petitioner is not entitled to be released on emergent parole on the ground of marriage of his brothers. 5. Having heard learned counsel for the petitioner and learned Additional Advocate General, we find that this matter ought to receive consideration of the District Collector, Jaipur, who has the power to consider and grant the request for emergent parole in appropriate cases. 6. It would be open to the petitioner to make fresh application along with all the relevant documents to the District Collector, Jaipur, who shall after verification of the facts aforesaid, consider and decide the application within three days from the date of its making in accordance with law. The petition is disposed off.
