JUDGMENT : Biswanath Somadder, J. 1. In view of the explanation provided in paragraphs 43 of the application for stay, the defect, as pointed out by the Additional Stamp Reported in his order dated 18th September, 2018, shall be deemed to have been removed. 2. By consent of the parties, the appeal is treated as on day's list and taken up for consideration along with the application for stay. 3. The instant appeal arises out of an order dated 26th July, 2018, passed by a learned Single Judge in WP 12607 (W) of 2018 with CAN 5272 of 2018 (Amitava Ghose vs. The State of West Bengal & Ors.). By the impugned order, the learned Single Judge refused to pass any interim order interfering with the election and directed the writ petition to be heard upon exchange of affidavits. 4. The present appeal has been preferred by the writ petitioner who claims to be the Vice-Chairman of the superseded Board of Saptaparni Co-operative Housing Society Limited. 5. Without even going into the merits of the controversy in issue, we are of the view that the parties may be relegated to the learned Co-operative Tribunal where Appeal No.6/18 is pending so that all issues are resolved before it instead of the writ Court sitting in adjudication over the matter, which essentially falls within the domain of the learned Co-operative Tribunal. 6. We, therefore, direct the appellant as well as all other parties to approach the learned Co-operative Tribunal seeking expeditious disposal of the Appeal No.6/18. 7. We make it clear that the learned Co-operative Tribunal shall decide the appeal on its own merit without being influenced in any manner by any observation made by the learned Single Judge in the impugned order dated 26th July, 2018, as expeditiously as possible, without granting any unnecessary adjournment to the parties. 8. The appeal and the application for stay stand disposed of along with the writ petition, being WP 12607 (W) of 2018. 9.
