JUDGMENT Mrs. Anita Chaudhry, J.:- The petitioner is seeking regular bail in FIR No. 105 dated 21.7.2017 registered at Police Station Balachaur, District SBS Nagar under Sections 306 IPC (Section 302 IPC already deleted). 2. Counsel for the petitioner contends that petitioner is in custody since 26.7.2017 and challan has been presented and he is not named in the FIR. The counsel further submits that two girls entered into a suicide pact and ended their life by jumping into the canal. The counsel urges that initially the FIR was registered under Section 302 IPC which was deleted and challan has been presented under Section 306 IPC. The counsel further submits that the teacher in the school had caught a phone from Rupinderjit Kaur (also deceased) and the teacher had taken the girl from her class and the class incharge had informed another teacher and a phone call was given to the parents and a statement was made by the girl that it was another girl Manpreet who used this phone and used to chat with a boy and since the parents had come to know of it, both the girls got scared and though they used to take different bus to go to home but they took the same bus and got down at Balachaur and jumped into the canal and the petitioner had no role in the incident. Counsel for the petitioner also contends that whatsapp chat which has been filed along with the challan is not by the petitioner but the other accused who is on bail and he used to chat with the other girl. 3. State counsel submits that the mobile phone which the girl was using, was recovered from the petitioner. 4. Karanjit Singh against whom there is a separate FIR relating to the death of one of the girls had been allowed bail. Investigation is over. Challan has been presented. It is the class incharge namely Anuradha who had made a call since a mobile phone was recovered from the girl. It is in the same afternoon that the girls committed suicide. The petitioner was not named in the FIR. The trial will take time. 5.

Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate.
