ORDER : 1. We have heard learned counsel for the parties. 2. By the consent of the parties, in super-session of the impugned award, we appoint Justice S.N. Variava (Retd.), former Judge of this Court as an Arbitrator to decide the disputes between the parties. 3. The scope of dispute will be same which was subject matter of dispute before the earlier Arbitrator. 4. The Arbitrator shall be at liberty to fix his own remuneration and any other terms and condition for the arbitration in consultation with the parties in accordance with law. 5. We request the learned Arbitrator to decide the matter expeditiously. 6. Let a copy of this order be communicated to the learned Arbitrator so that he may enter upon the reference as expeditiously as possible. 7. The parties will appear before the Arbitrator for further proceedings on Tuesday, the 10th July, 2018. 8. The appeals are disposed of in above terms.
