JUDGMENT : 1. This petition has been filed by the petitioner for grant of emergent parole for a period of 30 days on the ground of marriage of his sister namely; Akshi, which is going to be solemnised on 20.04.2018. 2. Contention of learned counsel for the petitioner is that petitioner is serving sentence of life imprisonment in Central Jail, Sewar, Bharatpur. D.B. Criminal Appeal preferred by petitioner against the judgment of conviction and sentence is pending before this Court. Petitioner was earlier released on regular first parole for a period of 20 days and he surrendered himself on due date. There was no complaint during parole period. 3. It is contended that marriage of petitioner's sister namely; Akshi is going to solemnise on 20.04.2018. There is no other responsible male member in the family, who can perform the religious rituals and rites and make arrangement of expenditure for marriage. There is even no complaint against him by the jail authorities. Hence this petition for emergent parole. 4. Shri B.N. Sandu, learned Additional Advocate General opposed the petition and submits that petitioner is not entitled to be released on emergent parole on the ground of marriage of his sister. 5. Having heard learned counsel for the petitioner and learned Additional Advocate General, we find that this matter ought to receive consideration of the District Collector, Bharatpur, who has the power to consider and grant the request for emergent parole in appropriate cases. 6. It would be open to the petitioner to make fresh application along with all the relevant documents to the District Collector, Bharatpur, who shall after verification of the facts aforesaid, consider and decide the application within a week from the date of its making in accordance with law. The petition is disposed off.
