BISWANATH SOMADDER, MOUSHUMI BHATTACHARYA

body2018
JUDGMENT : Biswanath Somadder, J. 1. In Re: CAN 6555 of 2018 After considering the submission made by the learned advocate for the appellants/applicants and upon perusing the application for condo nation of delay, it appears that sufficient cause has been shown to explain the delay in filing the review. As such, the delay is condoned. 2. The application for condo nation of delay is accordingly allowed. In Re: RVW 116 of 2018 3. The instant review is in respect of a judgment and order dated 16th January, 2018, passed by this Bench in MAT 1316 of 2017 with CAN 10322 of 2017. 4. A bare perusal of the judgment and order under review reveals that we had not interfered with the judgment and order of the learned Single Judge dated 2nd May, 2017, which was rendered in WP 26160 (W) of 2016 (Ramkrishna Sahoo & Ors. vs. The State of West Bengal & Ors.). However, we modified the directions given by the learned Single Judge to the following extent:- "The amount of compensation shall be paid to the respondents/writ petitioners in accordance with the provisions of the Act of 2013 within a period of twelve weeks from the date of communication of a photostat certified copy of this order." 5. None of the grounds for review as envisaged under Order XLVII are noticeable in respect of the part of the direction of the learned Single Judge, which was modified by us as quoted above. 6. As such, we are of the view that the review is liable to be dismissed and stands accordingly dismissed. This order of dismissal, however, shall not prevent the review applicants to seek review of the judgment and order dated 2nd May, 2017, passed by the learned Single Judge in WP 26160 (w) of 2016, in accordance with law. Moushumi Bhattacharya, J. - I agree.
