ORDER : 1. Leave granted. 2. The case of the appellant is that prior to the acceptance of the tender on 22.03.1996, the appellant withdrew his offer through a letter that was delivered by hand, which letter was dated 20.03.1996. This letter was given to one Shri Ved Prakash who was a staff member of the respondent. The appellant, therefore, wants to prove, by producing a photo copy of the attendance register, that Shri Ved Prakash was indeed present on that date. 3. According to us, since the respondent-Union of India itself has not been able to produce the original, it will be open for the appellant to lead secondary evidence of the photo copy of this attendance register by recalling PW 1. 4. The appeal is allowed accordingly. 5. Pending applications, if any, shall stand disposed of.
